FREE LEGAL AID- WE DO IT!

When you are prosecuted by the Garda and asked to attend court on foot of receiving a summons or a charge sheet, you are always entitled to ask the court to consider granting you free legal aid to cover the costs of your defence of the charges. In reality this application is made by your defence solicitor to the Judge on the first occasion you appear in court. Normally if you earn more than €400 euro per week, the court will not grant you free legal aid. If you are in receipt of social welfare you will be granted legal aid. If granted legal aid, the state pays for your legal representation and you do not owe your solicitor anything for representing you at court. Your solicitor can also ask for an interpreter if your English is poor.

GARDA STATION INTERVIEWS AND ARRESTS

If you are attending a Garda station to give a statement or to be interviewed, you should consult a solicitor. Niall Fox has years of experience built up attending interviews in both Northern Ireland and the Republic of Ireland.

It is important that you have a solicitor present to ensure your rights are protected. Garda Stations can be intimidating especially if you are attending for the first time. The reality is that the majority of people have never been arrested. An arrest is both a terrifying and sobering experience. The whole process of arrest and detention can place you and your extended family under a great deal of stress.

The Gardai will want you to talk to them and may make you even feel like you have to say something. SEXUAL OFFENCES

We have built up considerable experience dealing with defending persons accused or prosecuted for sexual offences.

If you have been accused of committing a sexual offence, the Gardai are going to want to interview you. They may ask you attend at a Garda station on a voluntary basis “to give your side of the story” or they may just arrest you, and seize any potential evidence such as your mobile phone and computers, or even clothes.

In terms of sexual offences in Ireland, they may be investigating you in respect of one of the following serious sexual offences:

EXTRADITION AND EUROPEAN ARREST WARRANTS

At Niall Fox Solicitors- We have built up considerable experience in the area of Extradition and specifically the execution, defence and hearing of European Arrests Warrants.

Extradition means the transfer of someone from one country to another for the purpose of prosecution or punishment for an offence of which they have been convicted. In general, extradition is only possible if there is an extradition agreement between the two countries in question. This means that Ireland must have an agreement with the other country before someone can be extradited to or from Ireland.

Individual countries also have specific rules about extradition. For example, Ireland does not allow extradition for the purposes of investigation of a criminal offence only.


Extradition between EU member states is specifically governed by the European Arrest Warrant legislation 2003. Extradition to other countries from Ireland is governed by the Extradition Act 1965 as amended.


We have experience of representing individuals facing extradition to countries inside and outside the EU. These proceedings usually take place at the Central Criminal Court in Dublin.
